By logging into your account, or uploading files to it or instructing HazleNet to do work on your behalf, you are indicating your acceptance of HazleNet's Terms of Service.
1. TERMS OF SERVICE
HazleNet provides World Wide Web page
hosting and Domain Registration. HazleNet reserves the right to suspend or cancel a customer's access to any or all services provided by HazleNet when HazleNet decides that the account has been inappropriately used or otherwise as mentioned in the below sections. We reserve the right at any time to access, amend, remove or delete any or all data stored on our servers without your prior consent. When your account is closed, all files (including web pages, etc.) will be deleted. We reserve the right to cancel your account at any time without notice. To protect your privacy we never distribute your name or e-mail address to any third parties, unless instructed to do so by order of a Court.
2. COMPLAINTS
We endeavour to respond to all complaints within five working days - although usually response is much quicker. If you are unhappy with any service provided by HazleNet please contact us immediately ...either... by clicking here. Your satisfaction is very important to us so please let us know if you have a problem. All disputes will be resolved in a legal jurisdiction of HazleNet’s choice.
3. SERVER
USE
Personal accounts are to be used by the primary owner only. You must not divulge your username or password
to any other person, and you should take reasonable precautions to ensure that other people do not discover it.
4. BACK-UPS
We do not backup client data stored on our servers. It is recommended that you keep an independent backup of all data stored on your virtual server
or dedicated server
unless otherwise stated.
5. SERVER
CONTENT
HazleNet do not allow any of the following content to be stored on its servers: Illegal Material - this includes copyrighted works, commercial audio, video or music files and any material in violation of any Federal, State or Local regulation. Adult Material - includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of HazleNet. Warez - includes pirated software, ROMS, emulators, phreaking, hacking, password
cracking, IP spoofing, MP3's, games patches or games orientated material etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.
6. BANDWIDTH
POLICY
Bandwidth
is the amount of accrued data transferred between your web site
and the sites visitors. Your bandwidth
limit is described in the package details or in you hosting control panel (Cpanel) should you exceed this limit by a small amount every so often you will not incur any penalties. Should your site become a large drain on our resources we do reserve the right to suspend your account until a suitable solution is reached.
7. SERVER
MAINTENANCE
While HazleNet does make every reasonable effort to ensure all our clients are informed well in advance of any scheduled maintenance, there are times were maintenance must be carried out without prior notification.
HazleNet will always try, although this is not always possible, to give some notice even if it is just an email
/ phone / Facebook / Twitter, prior the services go offline
.
8. FOOTER NOTE ON DESIGNED & HOSTED SITES
HazleNet reserve the right to have accreditation placed on the footer of the web site
of at least the home page
, unless otherwise agreed in additional terms and conditions agreed by both parties. If the client wishes to remove this there is an admin charge of £499.00 per year.
9. WEB DEVELOPMENT
Web Development is any and all work carried out for the purpose of online deployment, either for use regionally or worldwide.
10.1 INTELLECTUAL PROPERTY
Unless otherwise agreed, HazleNet remains the owner of any and all intellectual property that is used or created for a client’s web development project. This includes but not limited to: web site
design whether the design progresses to development and build or not. Any and all computer Code used in the construction or modification of a web development project. Any and all databases constructed by HazleNet. Any and all process developed by HazleNet. Any and all know how, tutorials, or formula developed or produced by HazleNet. Any and all inventions and / or discovery made by HazleNet.
9.2 COPYRIGHT
HazleNet remains the owner of any and all work created and or modified during any and all web development projects. All work is licensed for use on a HazleNet servers or a subsidiary of HazleNet. If any work is being carried out on a third party supplier the work would also be licensed for the current third party supplier.
Should any of the following be considered HazleNet must be consulted before any work is started to ensure that the client has the correct licence: moving to a different hosts other than HazleNet or a subsidiary of HazleNet. Allowing third party develops to edit any and all work created by HazleNet. Ownership transfer of Online presence project ether as part of a company transfer or by itself.
9.3 PHOTOGRAPHY
All photographs produced by HazleNet's photography are copyrighted to HazleNet. HazleNet reserves the right to place a watermark on any and all images before they leave HazleNet’s network
. HazleNet reserves the right to charge an extra fee for use of photographs in different regions worldwide. HazleNet reserves the right to cancel any and all licences and to request that photographs are no longer used / distributed. HazleNet reserves the right to charge for licensing on an annual basis at a cost to be determined at the time.
9.4. GRAPHIC DESIGN WORK
All work produced by HazleNet's Graphic Design Artists (Graphic Designers) is copyrighted to HazleNet. HazleNet reserves the right to charge an extra fee for use of images in different regions worldwide. All graphics design work is licensed for what it was created for; HazleNet reserves the right to request payment for licensing any and all work that is used outside the originally agreed use.
10. MAINTENANCE PACKAGE
All Maintenance Packages are governed by the terms of service attached to the “Package agreement form”.
11. CANCELLATION AND REFUNDS
HazleNet reserves the right to cancel the service at any time. In this event customers may be entitled to a pro rata refund based upon the remaining period of service. If a customer contravenes HazleNet's terms of service, a refund will not be issued in the event of a cancellation.
12. ACCOUNTS
Accounts are any and all Financial agreements that all clients agree to for the purposes of payment for services and products supplied by HazleNet.
12.1 LATE FEES
HazleNet reserves the right to charge late fees at £5.00 or 5% whichever is greater per month, per service. HazleNet reserves the right to stop / cancel / suspend any of your services due to non-payment.
It is at the discretion of HazleNet whether or not the action detailed in section 12.1 is taken.
12.2 REACTIVATION FEES
In the event HazleNet stopping / cancelling / suspending services due to non-payment, HazleNet reserves the right to charge £20.00 per service to reactivate / start / unsuspend your service. Although this may happen as soon as HazleNet receives cleared funds this may take up to two business days.
It is at the discretion of HazleNet whether or not the action detailed in section 12.2 is taken.
12.3 ARREARS
HazleNet considers any outstanding balance older than 30 days from the date of the invoice to be “In Arrears”. If such an incident should occur HazleNet reserves the right to take the action detailed in section 12 of HazleNet’s “Terms of Service”.
HazleNet reserves the right to take the following action should the below conditions become true:
An Arrears is unpaid for 150 days.
OR
An Arrears amount is equal to or greater than £700.00
Should these conditions become true, HazleNet reserves the right to take the following action:
HazleNet will take ownership of the following:
Domain Names (All TLD registered by HazleNet)
Web Sites
Email
Address
All data stored on HazleNet systems including but not limited to emails, databases, contact, images, photographs and copy.
Hard Copies Provided to HazleNet
Hardware HazleNet currently has, this includes but is not limited to new I.T. Hardware, Hardware that HazleNet is reparing.
In the event that the arrears remain unpaid for another 60 days, HazleNet reserves the right to sell the previously described to recover all or part of the outstanding arrears.
12.3 COST OF RECOVERING ARREARS
HazleNet will add the cost of recovery to the current outstanding balance / arrears.
Please Note: It will cost more not paying your invoice on time and could damage your credit rating.
13. INDEMNIFICATION
The customer agrees that it shall defend, indemnify, save and hold HazleNet harmless from any and all demands, liabilities, losses, costs and claims, including all attorney's fees asserted against HazleNet, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. The customer agrees to defend, indemnify and hold harmless HazleNet against liabilities arising out of: (1) any injury to person or property caused by any products sold or otherwise distributed in connection with HazleNet server
; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from HazleNet's server
.
14. ASSISTANCE
We do try to help people as much as possible, but there is a limit to how much because of time restrictions. Helping those unfamiliar with the web is something we like to offer but does not constitute part of our packages. At times we will not be able to help - such as during busy periods or perhaps holiday times and occasionally the problem may be beyond the scope of our knowledge. Whilst we always try, refunds will not be made on the basis of non-assistance provided that any problems encountered are not connected to a fault in our domain name
or hosting service.
15. DISCLAIMER
Whilst every care is taken by HazleNet in the provision of our services we cannot be responsible for any damages your business may suffer through technical outages or other occurrences. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by HazleNet, its employees, suppliers, customers or any third party. HazleNet reserves the right to revise its policies at any time. This does not affect your statutory rights as a consumer.
No failure or delay by a party to exercise any right or remedy provided under this Terms of Service or by law shall constitute a waiver of that or any other right or remedy, nor shall it preclude or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that or any other right or remedy.
